OVERVIEW

Welcome to Snazzi Pink Shop. The terms “we,” “us” and “our” refer to Snazzi Pink Shop. Snazzi Pink Shop operates this website and store, including all related information, content, features, tools, products and services provided to customers collectively as the “Services.”

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when accessing or using our Services.

Please read these Terms carefully. They contain important information concerning your legal rights, warranties, limitations of liability, product use and dispute resolution.

By visiting, interacting with or using our Services, including placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, you should not access or use our Services.

SECTION 1 — ELIGIBILITY, ACCESS AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence.

If you permit a minor dependent to access the Services using a device, payment method or account that you own or manage, you accept responsibility for that minor’s activity.

To browse the store, create an account or place an order, you may be asked to provide information including your name, email address, billing information, payment information and shipping address.

You represent that the information you provide is accurate, current and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You may not sell, transfer, assign or license your account to another person.

We reserve the right to refuse service, suspend accounts or cancel orders when reasonably necessary to prevent fraud, abuse, unlawful activity or violations of these Terms.

SECTION 2 — PRODUCTS, DESCRIPTIONS AND AVAILABILITY

We make reasonable efforts to accurately display and describe our products. However, colors and product appearance may vary depending on lighting, photography, screen settings and the device used to view the store.

Because handmade and embellished products contain hand-placed elements, minor variations in decoration, placement or finish may occur. These variations are part of the handmade nature of the product and are not necessarily defects.

Product descriptions, prices, measurements, availability and other information may be corrected or changed without notice.

We reserve the right to:

• Discontinue a product at any time
• Limit available quantities
• Restrict sales to particular customers, locations or jurisdictions
• Substitute equivalent packaging or preparation materials when necessary
• Decline orders involving suspected fraud, unauthorized resale or pricing errors

Products displayed online may sell out, particularly New Drops, Handmade sets, Custom Fit sets, Pop-Up Shop products and limited seasonal designs.

SECTION 3 — SNAZZI FIT™ MEASUREMENTS AND SIZING

Snazzi Pink Shop measures and categorizes press-on nail products to provide customers with more useful sizing and fit information.

Measurements are taken manually and may vary slightly, approximately ±0.5 millimeters.

Press-on nail fit is affected by more than width. Natural nail curvature, the press-on nail’s C-curve and apex, sidewall coverage, nail-bed shape and application technique can all affect fit.

Customers are responsible for:

• Measuring according to the Snazzi Fit™ Guide
• Reviewing the measurements and Fit Profile shown on the product listing
• Considering natural nail curvature
• Selecting an appropriate size
• Sizing up when between sizes

Product measurements and Snazzi Fit™ recommendations are intended as purchasing guidance. They do not guarantee that every nail in a set will fit every natural nail shape.

If you measured according to the Snazzi Fit™ Guide and your set still does not fit, your available size remedy is governed by the Snazzi Fit™ Promise in our Refund Policy.

SECTION 4 — ORDERS AND ACCEPTANCE

Placing an order is an offer to purchase. Your order is not accepted until payment has been successfully processed and we confirm the order.

We reserve the right to accept, reject, limit or cancel an order for reasons including:

• Product unavailability
• Suspected fraud
• Payment authorization problems
• Pricing or product-information errors
• Unauthorized resale
• Shipping restrictions
• Violations of these Terms

If we decline or cancel an order after payment, we will refund the affected amount to the original payment method.

Please review your order before submitting it.

Address corrections, size changes and other order modifications may be requested before the shipping label is printed. Once a label has been created or an order has entered fulfillment, we cannot guarantee that changes or cancellations can be made.

To request a change, contact us as quickly as possible and include your order number.

SECTION 5 — PERSONAL USE, WHOLESALE AND RESALE

Unless purchased through an approved wholesale arrangement, products purchased through our retail store are intended for personal or household use.

You may not purchase products for unauthorized commercial resale, deceptive relabeling, export in violation of applicable law or use that infringes our intellectual property.

Approved wholesale customers may purchase products for resale subject to a separate wholesale agreement, pricing terms, minimums and resale requirements.

SECTION 6 — PRICES, PROMOTIONS AND BILLING

Prices, discounts and promotions may change without notice. The amount charged will be the price displayed at checkout when the order is placed.

Unless expressly stated, listed prices do not include applicable taxes, shipping charges or other charges shown at checkout.

Prices offered online may differ from prices offered:

• At markets and in-person events
• In the Online Pop-Up Shop
• During Pink Weekend promotions
• Through wholesale arrangements
• Through subscriptions
• Through third-party marketplaces

Market pricing, Pink Friday offers, Pink Weekend promotions, Pop-Up Shop pricing and other promotional programs may have separate eligibility, dates, quantities and terms.

If promotional terms conflict with these Terms, the specific promotional terms will control for that promotion.

You agree to provide accurate and complete billing, payment and account information. You represent that you are authorized to use the payment method submitted and agree to pay all charges authorized through your order.

Obvious pricing errors may be corrected. If an error affects an order you placed, we may contact you to confirm the corrected price or cancel and refund the affected item.

SECTION 7 — SHIPPING AND DELIVERY

Ready-to-ship orders are generally processed within two business days unless a product listing states a different production or processing period.

Shipping rates are calculated at checkout. Orders are currently shipped within the United States using USPS or another carrier displayed during checkout.

Tracking information will be provided by email when the shipping label is created. Tracking activity may not appear immediately after label creation.

Processing and delivery estimates are not guarantees. Delivery may be affected by carrier delays, holidays, severe weather, incorrect addresses and circumstances outside our reasonable control.

If we cannot ship within the timeframe promised at purchase, we will notify you and provide the option to accept the delay or cancel the unshipped portion of the order for a refund as required by applicable law.

Customers are responsible for providing a complete and accurate delivery address.

If tracking shows that a package was delivered but it cannot be located, please:

1. Allow 24 hours because some packages are scanned before final delivery.
2. Check with household members, neighbors and appropriate building personnel.
3. Verify the shipping address on the order.
4. Contact us so we can help you work with the carrier.

SECTION 8 — RETURNS, REFUNDS AND FINAL-SALE ITEMS

Because press-on nails are hygiene products, returns are limited to eligible unopened and unused items in their original sealed packaging.

Eligible return requests must generally be initiated within 14 days of delivery. Customers are responsible for approved return-shipping costs unless the return results from our error or applicable law requires otherwise.

Original shipping charges are not refundable.

The following products are final sale unless our Snazzi Fit™ Promise, damaged-item policy, defect policy or applicable law provides otherwise:

• Handmade sets
• Custom Fit sets
• Pop-Up Shop exclusives
• Clearance items
• Opened or used nail products
• Used adhesives, debonders or application products
• Personalized products
• Gift cards

Manufacturing defects should be reported within seven days of delivery. Damage in transit should be reported within 48 hours of delivery. Photographs may be required to document the issue.

Wrong items shipped by us will be corrected at our expense.

One fit exchange may be available per eligible order under the Snazzi Fit™ Promise. The Fit Promise provides a corrected size solution and is not a general refund program.

SECTION 9 — PRODUCT USE AND SAFETY

Press-on nails, nail glue, adhesive tabs, nail debonder, nail tools and related products must be used only as directed.

Nail glue can bond skin and eyes quickly. Avoid contact with skin, eyes, clothing and surfaces not intended for application. Keep nail glue, debonder, press-on nails, adhesive tabs and small tools away from children and pets.

Do not use a product if its packaging is damaged or if you are sensitive or allergic to any listed ingredient.

Discontinue use if irritation, pain, redness, swelling or another adverse reaction occurs. Seek appropriate medical assistance when necessary.

Never forcefully pull or pry off a press-on nail. Follow the Snazzi Safe Removal System and the instructions provided with your products.

Soaking can loosen three-dimensional art, pearls, crystals and other embellishments. Handmade and heavily embellished products should be removed using the recommended debonder method.

Our product instructions and sizing information are provided for general educational purposes and are not medical advice.

SECTION 10 — SNAZZI KIDS™ PRODUCTS

Tiny Hands™ and Mini Glam™ products are designed for jelly-tab application only. Liquid nail glue is not included with these collections.

Tiny Hands™ and Mini Glam™ products must be applied with adult assistance and supervision.

Teen Pop™ products may include liquid nail glue unless the customer selects an available glue-free option. Adult supervision is recommended whenever nail glue is used.

Press-on nails, adhesive tabs and application tools may be small parts. Keep them away from children under three years of age and anyone who may place them in their mouth.

Age ranges are general guidance. The child’s actual thumbnail measurement should be used to select a size.

SECTION 11 — LOCAL PICKUP

When local pickup is available, customers must wait until they receive confirmation that the order is ready before arriving.

Pickup orders must be collected from the designated location during the stated pickup window. We may request the order confirmation and identification matching the customer or authorized pickup person.

Local pickup availability, locations and hours may change.

Unclaimed pickup orders may be handled according to the instructions communicated with the order. Refund eligibility remains subject to the Refund Policy.

SECTION 12 — PARTIES, EVENTS AND SERVICES

Nail parties, Sip & Snazzi events, bridal events, children’s events, pop-ups, market appearances and similar services may be subject to a separate quote, invoice, booking agreement, deposit requirement and cancellation policy.

A party or event is not reserved until the required booking steps and payment requirements have been completed.

Guest counts, travel, venue requirements, setup needs, product selections, service limitations and cancellation terms will be stated in the applicable booking documents.

If event-specific terms conflict with these general Terms, the signed booking agreement or event-specific terms will control for that event.

SECTION 13 — SUBSCRIPTIONS AND RECURRING PURCHASES

If we offer subscription products or recurring purchases, the subscription details shown at enrollment and our Subscription Policy will govern those purchases.

Subscription terms may include:

• Recurring billing frequency
• Box contents or product-selection rules
• Shipping charges
• Renewal dates
• Cancellation deadlines
• Skipping or pausing options
• Introductory or founding-member pricing
• Changes to future subscription pricing

By enrolling in a paid subscription, you authorize recurring charges according to the terms presented before checkout.

Subscription products will not be governed solely by “coming soon” or waitlist language. The complete Subscription Policy will be provided before paid enrollment begins.

SECTION 14 — INTELLECTUAL PROPERTY

The Services and their contents—including trademarks, names, logos, slogans, text, graphics, product descriptions, sizing charts, photographs, videos, reviews, designs, page layouts and educational materials—are owned by Snazzi Pink Shop, its affiliates or licensors and are protected by applicable intellectual-property laws.

This includes, without limitation, Snazzi Pink Shop branding and proprietary program names such as:

• Snazzi Fit™
• Snazzi Toes™
• Snazzi Kids™
• Tiny Hands™
• Mini Glam™
• Teen Pop™
• Snazzi Safe Removal System
• Prep & Slay Kit

You may use the Services only for personal, noncommercial purposes unless we provide written permission.

You may not reproduce, distribute, republish, modify, scrape, copy, sell, license, create derivative works from or commercially exploit our content without prior written permission.

Nothing in these Terms grants you ownership or a license to use our trademarks, copyrights or other intellectual property except for the limited personal use expressly permitted.

Shopify’s names, logos and trademarks belong to Shopify or its licensors. Other marks displayed through the Services belong to their respective owners.

SECTION 15 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, applications, payment services, social-media integrations or other services operated by third parties.

We do not control all third-party tools and provide access to them on an “as is” and “as available” basis.

Your use of third-party services may be governed by that third party’s terms and privacy policy. You are responsible for reviewing those terms before using the service.

We are not responsible for harm arising solely from third-party services outside our reasonable control, subject to applicable law.

New features, tools and resources added to the Services will also be subject to these Terms.

SECTION 16 — THIRD-PARTY LINKS

The Services may contain links to websites operated by third parties.

We are not responsible for evaluating or guaranteeing the accuracy, safety, availability or practices of third-party websites.

If you leave our Services to access a third-party website, you do so at your own discretion. Review the third party’s terms, privacy policy and return practices before completing a transaction.

Questions concerning third-party products or services should be directed to the applicable third party.

SECTION 17 — RELATIONSHIP WITH SHOPIFY

Snazzi Pink Shop is powered by Shopify, which enables us to provide the Services.

Sales and purchases made through our store are transactions directly between you and Snazzi Pink Shop.

Shopify is not the seller of our products and is not responsible for product fulfillment, fit, quality, safety, returns, refunds or customer service relating to purchases from Snazzi Pink Shop.

To the fullest extent allowed by law, you release Shopify and its affiliates from claims arising solely from your purchase or transaction with Snazzi Pink Shop.

SECTION 18 — PRIVACY

Personal information collected through the Services is handled according to our Privacy Policy:

Because Shopify hosts the Services, Shopify may collect and process information concerning your access to and use of the Services to operate and improve the platform.

Information may also be shared with service providers involved in payment processing, order fulfillment, shipping, analytics, marketing, fraud prevention and customer support, as described in the Privacy Policy.

By using the Services, you acknowledge that you have reviewed the applicable privacy policies.

SECTION 19 — FEEDBACK, REVIEWS AND USER CONTENT

If you submit a review, photograph, video, comment, suggestion, testimonial or other content to us, you represent that you own the content or have permission to submit it.

You grant Snazzi Pink Shop a worldwide, nonexclusive, royalty-free, sublicensable license to use, reproduce, adapt, publish, display and distribute that content for operating, improving and promoting the Services.

You remain responsible for your content and its accuracy.

You may not submit content that:

• Violates another person’s rights
• Is false, defamatory, threatening, abusive or obscene
• Contains confidential information you do not have permission to disclose
• Contains malicious code
• Misrepresents your identity or relationship with us
• Fails to disclose compensation or incentives connected to a review when disclosure is required

We may monitor, edit or remove user content that violates these Terms or applicable law, but we are not obligated to monitor all content.

SECTION 20 — ERRORS, INACCURACIES AND OMISSIONS

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions involving product descriptions, measurements, pricing, promotions, availability, shipping charges or delivery estimates.

We may correct errors, update information or cancel affected orders at any time, including after an order has been submitted.

If we cancel a paid order because of an error, we will refund the affected amount.

SECTION 21 — PROHIBITED USES

You may use the Services only for lawful purposes.

You may not use the Services to:

• Violate any law or regulation
• Infringe intellectual-property or privacy rights
• Harass, threaten, abuse, defame or harm another person
• Submit false, fraudulent or misleading information
• Transmit viruses, malware or harmful code
• Send spam, phishing messages or unauthorized solicitations
• Impersonate another person or entity
• Collect personal information about others without authorization
• Circumvent security or access-control measures
• Interfere with the operation of the Services
• Scrape, extract or reproduce store content for unauthorized commercial use
• Use automated tools or agents in a manner that damages, overloads or circumvents restrictions on the Services
• Purchase products through fraudulent payment methods
• Exploit pricing, discount or technical errors

We may suspend or terminate access when we reasonably determine that these Terms have been violated.

SECTION 22 — TERMINATION

We may terminate or restrict your access to the Services when you violate these Terms, create risk or liability, engage in suspected fraud or misuse the Services.

Termination does not eliminate payment obligations or liabilities incurred before termination.

Provisions relating to intellectual property, warranties, liability, indemnification, privacy, dispute resolution and other provisions that by their nature should survive will remain effective after termination.

SECTION 23 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by law, and except for obligations expressly stated in our published policies, the Services and products are provided “as is” and “as available.”

We do not guarantee that:

• The Services will always be uninterrupted or error-free
• Every product will appear identical on every screen
• Every press-on nail will fit every natural nail
• Every product will remain continuously available
• Every carrier will deliver within its estimate
• Every product will achieve a particular wear time

Wear time depends on preparation, application, adhesive selection, lifestyle, water exposure, natural nail condition and removal practices.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT, EXCEPT WHERE SUCH WARRANTIES CANNOT LEGALLY BE EXCLUDED.

Nothing in these Terms excludes rights or remedies that cannot be waived under applicable law.

SECTION 24 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, SNAZZI PINK SHOP AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SERVICE PROVIDERS AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING FROM THE SERVICES OR PRODUCTS.

THIS INCLUDES, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION OR REPLACEMENT COSTS, EVEN IF ADVISED THAT SUCH DAMAGES MAY BE POSSIBLE.

OUR TOTAL LIABILITY FOR A CLAIM RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, EXCEPT WHERE APPLICABLE LAW REQUIRES OTHERWISE.

These limitations do not apply to liability that cannot legally be limited or excluded.

SECTION 25 — INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless Snazzi Pink Shop, Shopify and our respective affiliates, owners, employees, agents, contractors, licensors and service providers from third-party claims, losses, liabilities and reasonable legal expenses arising from:

• Your material breach of these Terms
• Your violation of applicable law
• Your violation of another person’s rights
• Your misuse of the Services
• Content you submit through the Services

We will provide reasonable notice of an indemnifiable claim. You agree to cooperate in the defense of the claim.

We will not settle a claim in a way that imposes nonmonetary obligations on you without your reasonable consent.

SECTION 26 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent legally permitted and the unenforceable portion will be severed.

The remaining provisions will continue in effect.

SECTION 27 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms, together with our posted policies and any applicable product, promotion, subscription, event, wholesale or booking terms, constitute the entire agreement between you and Snazzi Pink Shop concerning the Services.

If a specific written agreement applies to a service or transaction, that agreement will control to the extent it conflicts with these general Terms.

SECTION 28 — ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms as part of a merger, reorganization, sale of assets, business transfer or similar transaction, subject to applicable law.

SECTION 29 — GOVERNING LAW AND VENUE

These Terms and any separate agreements through which we provide Services are governed by the laws of the State of South Carolina, without regard to conflict-of-law principles.

Subject to applicable law, legal proceedings arising from these Terms will be brought in a court with appropriate jurisdiction in Greenville County, South Carolina.

Nothing in this section prevents either party from bringing an eligible matter in small-claims court or exercising rights that cannot legally be restricted.

SECTION 30 — CHANGES TO THESE TERMS

We may update these Terms by posting a revised version on this page.

When required by applicable law, we will provide notice of material changes. The revised Terms will take effect on the date stated in the update.

Your continued use of the Services after the effective date means you agree to the revised Terms.
